Policies and practices regarding the governance of personal information

ISE Aquanox Inc. is committed to protecting all personal information collected and used in the conduct of its business. Our Privacy Policy describes our standards for the collection, use, disclosure and retention of your personal information and your right of access to it.

Definition and purpose of personal information collection

Personal information is data concerning an “identifiable individual”. It is information that, alone or in combination with other data, identifies you as an individual. Professional information such as corporate e-mail addresses and business telephone numbers is not considered personal information within the meaning of the Act.

Website Privacy Policy

At ISE Aquanox, we respect your right to privacy and the confidentiality of your personal information. We are committed to protecting your personal information and using it only for the purposes for which it was collected. We want you to know for what purposes and in what ways we collect personal information and how it is stored, used and disclosed.

The Privacy Policy extends to all personal information collected by ISE Aquanox from the ISE Aquanox website (https://www.iseaquanox.com/, hereinafter: the “Site”) (the “Policy”). The Policy is subject to Quebec’s privacy legislation, the Act respecting the protection of personal information in the private sector (LPRPSP), as well as other applicable legislative and regulatory provisions.

Applicable laws

The Policy complies with the laws set out in PIPEDA.

For residents of other Canadian provinces, the specific law of your province will apply or, in the absence of a specific law, the Personal Information Protection and Electronic Documents Act (PIPEDA). If there are any inconsistencies between the Policy, your provincial law or PIPEDA, your provincial law or PIPEDA will apply.

For residents of EU countries, the General Data Protection Regulation (GDPR) governs all data protection policies, regardless of where the site is located. The Policy is intended to comply with the GDPR. If there are any inconsistencies between the Policy and the RGPD, the RGPD will apply.

For residents of the State of California, this Policy is intended to comply with the California Consumer Privacy Act (CCPA). If there are any inconsistencies between this document and the CCPA, state law will apply. If we find inconsistencies, we will modify our Policy to comply with the relevant law.

By accessing and using the Site, you consent to:

  • The terms and conditions set out in the Policy;
  • The collection, use and retention of the personal information listed in the Policy.

Personal information collected

We collect only the personal information necessary to fulfill the purpose identified in the Policy. We do not collect any additional personal information without first informing you.

Personal information collected automatically

We do not automatically collect any personal information on our Site.

Personal information collected non-automatically

By visiting and using the Site, we may collect and save the following information when you perform certain functions:

  • professional and/or personal contact details, such as first name, surname, e-mail address, postal address and telephone numbers
  • quotation information, such as project type and description
  • financial and billing information, such as billing address, bank account information or payment details
  • site usage and other technical information, such as details of visits, your interaction with our advertising and online content, or information collected through cookies and other tracking technologies.

This personal information may be collected in the following ways:

  • when you create an account
  • when you submit a project
  • when you make a purchase

Use of personal information

Personal information collected on our Site will be used only for the purposes specified in the Policy or as indicated on the relevant pages of our Site. We do not use your information beyond what we disclose.

Information collected is used by ISE Aquanox for the following purposes:

  • To facilitate the use of our websites and to ensure that content is relevant and that the content of our websites is presented in the most effective manner for you and your device.
  • To enable us to process account and project requests
  • To enable us to process and track orders
  • To prevent and investigate possible breaches of our site security or activities that may be prohibited or illegal.

How personal information is used

We may disclose your personal information to any member of our organization who requires access to user data to achieve the purposes set out in the Policy.

Other disclosures

We will not sell or disclose your personal information to third parties, except in the following cases:

  • If required by law
  • If required to comply with a court order or similar legal process
  • To prove and protect our legal rights
  • Any entity or prospective purchaser in the event of a merger or change of control of the company, in whole or in part, and only if the parties enter into an agreement where the disclosure of personal information is limited to the business transaction.

Our Site contains links to other sites whose privacy policies and procedures may differ from those of ISE Aquanox. We are not responsible for and have no control over their policies. We encourage you to carefully read the privacy policy of any website you visit.

How we protect your personal information

To ensure the security of your personal information, we use Secure Socket Layer (SSL) technology. We follow recognized standards to protect the data you send us, both during transmission and once we receive it. Information is accessible only to our employees, who are bound by strict confidentiality agreements.

Although we take all reasonable precautions to ensure the security of user data and the protection of your personal information, we cannot guarantee absolute security.

Minors

We do not knowingly collect personal information from minors under the age of 14. Minors must have the consent of their parent or guardian to provide us with personal information. If you are a parent or guardian and are aware that your child has provided us with personal information, please contact our Privacy Officer. We will take steps to delete any personal information from our server.

Responsibility

We are responsible for the protection of personal information in our possession, including that which we entrust to third parties. Where applicable, these third parties will be clearly identified on the relevant consent form. Third parties are subject to the same standards and regulations as our company.

As stipulated by law, we have a Privacy Officer who oversees the application of the current policy as well as the processes and procedures surrounding the protection of your personal information. All our employees are aware of this policy and have been trained to apply it to the letter.

Consent

When we obtain information about you, we first ask for your written consent to collect, use or disclose your collected information for the identified purposes.

We will seek your consent for any other use, disclosure or collection of your personal information or when the purposes for which your information was collected change.

We will not disclose your personal information without your consent, unless authorized by the Privacy Act. In the event of a disclosure authorized by law, we will attempt to disclose only the specific information that is necessary in the circumstances and, to the extent possible, we will inform you of this.

How do we protect your personal information?

We will protect personal information against loss or theft, unauthorized access, use or disclosure, alteration or destruction, through appropriate administrative, technical and physical safeguards and best practices.

Retention of information

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected. The retention, disposal and destruction of personal information is carried out in accordance with the Government of Canada’s Directive on Privacy Practices and our Policy for the Management, Anonymization and Destruction of Personal Information, which is available upon request.

Request for access and modification

You may access or correct your personal information. You may also ask questions about how we use your personal information and for what purposes. We will provide you with this information within 30 business days of receiving your written request. You may only request information that relates to you, unless otherwise permitted or required by law.

Complaints and questions

If you have any complaints or questions about this policy or the way we handle personal information, you should write to the responsible person listed above.

Each complaint will be investigated internally and, where justified, we will take appropriate measures to respond and take corrective action where necessary. All complaints will receive an official response from the person in charge within 30 working days of receipt.

Updating the policy

This policy will be reviewed every three years or in the event of any changes to current legislation. In addition, if you believe that we are not adhering to the principles set out in this policy, you are invited to notify our manager, who will handle and process your request.
